Information relating to the German terminology in the lawyer’s profession

  • The professional term "Rechtsanwalt/Rechtsanwältin" was conferred upon the members of this law firm on the basis of Federal German legal standards and the responsible Ministry of Justice after its members passed their 2nd state examination in law, and a particular authorisation procedure by the President of the appropriate Oberlandesgericht (Higher Regional Court) (see above, Chamber of Lawyers / supervisory authorities).

1. Professional third party insurance scheme

  • Based on the BRAO, German lawyers are obliged to take out a professional third party insurance contract with a minimum amount insured of 250,000 Euro. Details are laid down in Section 51 BRAO. 4. Notes on fees

  • Note pursuant to Section 49 b paragraph 5 BRAO: A value of the matter in dispute (Gegenstandswert) is the value of the order (claim/subject) which is examined within the framework of the lawyer’s work. In the case of legal proceedings in court, the value of the matter in dispute is also called "Streitwert" (value in dispute), and within the framework of other proceedings at authorities, the said value is also referred to as "Geschäftswert" (business value).

    The court fees and/or fees charged by the appropriate authority derive from this value. The higher the value in question, the higher the lawyer fees. The "Gegenstandswert" pursuant to Sections 22 ff Rechtsanwaltsvergütungs-
    gesetz (RVG, Lawyers’ Fees Act) is also the basis for the pay to the lawyer.

    The "Gegenstandswert" is determined pursuant to the regulations of the RVG) and the "Gerichtskostengesetz" (GKG, Court Cost Act), the Wohnungseigentumsgesetz (WEG, Housing Property Act), and the Kostenordnung (KostO, Regulation of Court Costs). This value can be determined by the court. A determination by the court is relevant fort he lawyer fees.

    The "Gegenstandswert" (value of the matter in dispute) can change in the course of the legal proceedings. If the value decreases in the course of the proceedings, the lawyer will still be entitled to the fees which were already incurred in accordance with the higher value. In all other cases, the fees derive from the changed value.
